Tenants Rights Series (Part 1): Withholding Rent

Under Colorado law, if a landlord fails to ensure the habitability of a dwelling unit, the tenant can withhold rent from the landlord to pay for required repairs. BUT, the tenant must follow a series of required steps and allow the landlord time to perform the repairs. The applicable laws require the tenant to jump through a series of hoops before they are entitled to withhold rent for repairs. The steps are difficult to understand and even more difficult to successfully follow. We have put together a flowchart below as a guide for tenants wanting to withhold rent to make repairs.
